1. Introduction
These Terms of Sale ("Terms") govern all purchases made through https://shop.littlebig.band (the "Website") from LITTLE BIG FAMILY, LLC, a California limited liability company (EIN 92-2367967), ("Seller," "we," "us").
By placing an order, you ("Buyer," "you") confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and our Return & Refund Policy.
If you do not agree, please do not place an order.
2. Definitions
- Buyer — a natural person with full legal capacity who places an order through the Website for personal, family, or household use (not for resale or commercial purposes).
- Products — all goods offered for sale on the Website.
- Order — a request submitted by the Buyer to purchase one or more Products.
- Parties — Buyer and Seller, individually or together.
Only natural persons of legal age in their country of residence (and at least 18 years old) may place orders.
3. Offer and Acceptance
3.1. The information on the Website constitutes an invitation to make an offer. Your Order is an offer to purchase, which we accept by sending you an order confirmation email. A binding contract is formed only upon our confirmation.
3.2. We reserve the right to refuse or cancel any Order at our discretion, including (but not limited to) cases of suspected fraud, pricing errors, product unavailability, or inability to deliver to your location. If we cancel an Order after payment, you will receive a full refund.
3.3. We may update these Terms at any time. The version in effect at the time of your Order applies to that Order. Continued use of the Website after changes means you accept the updated Terms.
4. Buyer Responsibilities
4.1. You are responsible for providing accurate, complete, and up-to-date information (name, email, phone, delivery address). We are not liable for delivery failures caused by incorrect information.
4.2. You agree to purchase Products for personal use only, not for resale or other commercial purposes.
5. Products and Pricing
5.1. Product descriptions, images, and specifications on the Website are provided for information. Minor variations in color, design, or packaging are possible and do not constitute defects.
5.2. Prices are displayed on the Website in the applicable currency and may be changed at any time without notice. The price applicable to your Order is the price shown at the time you place the Order.
5.3. Pricing errors. If a Product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the Order and issue a full refund, or to offer you the option to proceed at the corrected price.
5.4. All prices exclude taxes, duties, and shipping fees unless stated otherwise. Applicable taxes will be added at checkout where required by law.
6. Payment
6.1. Payment is processed through our third-party payment providers (Stripe and PayPal). We do not store your full card details.
6.2. Full payment is due at the time of Order placement. Your Order will not be processed until payment is successfully received.
6.3. You represent that you are authorized to use the payment method you provide.
7. Shipping and Delivery
7.1. Shipping costs are calculated at checkout based on destination, weight, and chosen delivery method.
7.2. Estimated delivery times are provided for reference only and are not guaranteed. Delays may occur due to carrier issues, customs clearance, weather, or other circumstances beyond our control.
7.3. Risk of loss. Risk of loss and title pass to you upon delivery of the Products to the carrier, in accordance with applicable U.S. law. However, if a parcel is confirmed lost by the carrier before delivery, we will issue a full refund or ship a replacement at our discretion.
7.4. International orders. For shipments outside the United States, you are the importer of record and are responsible for all customs duties, taxes, and import fees imposed by the destination country. We are not responsible for delays caused by customs inspection.
7.5. Upon receipt, please inspect the package for visible damage and verify the contents against your Order. Report any issues within 7 days of delivery to shop@littlebig.band.
8. Returns, Refunds, and Exchanges
Returns and exchanges are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.
Summary:
- Returns are accepted within 30 days of delivery for items in original, unused condition.
- Defective or incorrectly shipped items are eligible for free return and replacement.
- Certain items are non-returnable (see Return Policy).
9. Statutory Consumer Rights
Nothing in these Terms limits your statutory rights as a consumer under the laws of your country of residence. In particular:
- EU/UK customers have a right of withdrawal within 14 days of receiving the Products under EU Directive 2011/83/EU and the UK Consumer Contracts Regulations 2013, in addition to our 30-day return policy.
- California customers retain all rights under California consumer protection law.

10. Warranties and Disclaimer
10.1. We warrant that Products delivered are new and free from material defects at the time of delivery.
10.2. EXCEPT AS EXPRESSLY STATED, PRODUCTS ARE PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
10.3. This disclaimer does not affect your non-waivable statutory rights as a consumer.
11. Limitation of Liability
11.1. To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to an Order shall not exceed the amount you paid for the Product(s) giving rise to the claim.
11.2. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or loss of data.
11.3. Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under applicable law.
12. Force Majeure
Neither Party shall be liable for any failure or delay in performance caused by events beyond reasonable control, including natural disasters, war, pandemic, government actions, carrier disruptions, or internet outages.
13. Intellectual Property
All content on the Website — including text, graphics, photos, logos, designs, and product images — is owned by the Seller or its licensors and is protected by copyright and trademark laws. You may not copy, reproduce, or use this content without our prior written permission.
14. Marketing Communications
By placing an Order or subscribing, you may receive order-related emails (transactional) from us. Marketing emails (newsletters, promotions) are sent only with your explicit consent via our email provider (Mailchimp). You can unsubscribe at any time using the link in any marketing email.
15. Privacy and Cookies
Our collection and use of your personal data is described in our Privacy Policy. The Website uses cookies as described in our Cookie Policy / Privacy Policy.
16. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17. Assignment
We may assign our rights and obligations under these Terms to a successor entity (e.g., in a merger or acquisition). You may not assign your rights without our prior written consent.
18. Governing Law and Disputes
18.1. These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles.
18.2. The Parties will attempt to resolve any dispute amicably through written communication. Response period: 14 business days.
18.3. Any unresolved dispute shall be brought in the competent courts of Los Angeles County, California, except where mandatory consumer protection laws of your country of residence grant you the right to pursue claims in your local courts. In that case, your local consumer protection law applies to the extent it is more favorable to you.
18.4. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.
